Supreme Court Rejects Miller's Petition in Miller v. Brand and Capital ...
CHICAGO, Dec. 11 /PRNewswire/ -- Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the U.S, announced that the United States Supreme Court has denied the Petition for Writ of Certiorari in the case of Miller v. Brand and Capital Machine, in effect concluding the case in favor of Brinks' client, Capital Machine Co., Inc. Inventors from Capital Machine and Miller Veneers, both based in Indianapolis, Indiana, each filed patent applications on methods of mounting and attaching a tapered log to a rotating apparatus in order to slice sheets of veneer from the tapered log, allowing for a more efficient use of the wood. At the U.S. Patent and Trademark Office Board of Patent Appeals and Interferences (USPTO), Miller Veneers argued that it had shown several drawings depicting certain elements of the invention to Capital Machine and that Capital Machine derived its invention from Miller Veneers based on those drawings.
Oil Futures Fall on Economic Concerns
At the pump, meanwhile, gas prices rose 0.2 cent overnight to a national average of $3.106 a gallon, according to AAA and the Oil Price Information Service. Gas prices have been on the rise for weeks, following oil's jump back into record territory. But with oil prices now sliding, the gains at the pump are likely to be limited, analysts say. February gasoline futures fell 8.12 cents to settle at $2.4298 on the Nymex Monday. Heating oil futures fell on forecasts for unseasonably warm weather in the Northeast over the next few days, said Addison Armstrong, director of exchange traded markets at TFS Energy Futures LLC in Stamford, Conn., in a research note. "Longer range forecasts are also expected to yield warmer than usual temperatures for the month of January, keeping a lid on demand until colder temperatures return," Addison said.
World Fuel Services Q3 earnings down 14%
World Fuel Services Corp. said its third quarter earnings fell 14 percent, hurt by a $1.9 million impairment charge. The Miami-based marketer and seller of marine, aviation and land fuel products said it earned $14.8 million, or 51 cents a diluted share, on revenue of $2.8 million. For the same quarter the year before, the company said it earned $17.2 million, or 59 cents a diluted share, on revenue of $3.6 million. World Fuel Services (NYSE: INT) recorded a $1.9 million impairment charge related to a commercial paper investment. The after-tax effect of the impairment charge was $1.3 million, or 5 cents a share. The company said its aviation segment brought in record gross profit of $33.2 million, a 20 percent year-over-year increase, partly benefiting from continued increases in jet fuel prices.
